Paypal dispute over ebay item


Recently I sold my ps3 on ebay, Link to the auction if it helps.

So this guy started asking me questions about my console which I expect and I told him everything he wanted to know, I sent him another 5 or so pictures that were not on the auction listing to show him exactly what he was getting because as a seller I like for the buyer to see exactly what they are dumping money on as its not a cheap purchase. A couple of these pictures showed the top and front of the console to show after 3 years it has the usual scratches that you can expect on the scratch prone ps3.. After a few emails with questions and picture requests this guy buys my item real quick and I ship it out to him, everything seems great. I even included a game not on the auction and paid an extra 25 dollars on the shipping to make sure the package got there in one piece to make sure the buyer was happy

Fast forward to yesterday: The guy receives the package and emails me that he is not pleased because I did not show him pictures of the back or the bottom of the console which had also been scratched. "Keep in mind that these scratches are no worse then a towel scratch on the hood of a car", If anyone here has a ps3 you know what I mean. So because of the light scratches on the back and bottom he opened a dispute regardless of the console working flawlessly and being exactly what he had seen in every picture i sent him. My auction never said it was in perfect condition, it clearly said it was Used next to the condition, as well as showing so in the pics I had sent privately. Also I looked through this guys ebay feedback and apparently this isnt the first time something along this line has happened.

The dispute says that the item "This item doesn't match the description in your listing." as well as "extensively different then described" I honestly dont see how either of these are possible as the guy received exactly what was shown in the auction in the exact condition I had stated through emails and pictures. He had never asked me to see pictures of the bottom or the back of the console so how would I know that it would have mattered to him? If it was an area of huge concern to him he should have asked to see said areas if i did not show him previously right?

so anyways, I'm looking for some opinions on the matter. Is this at all my fault or do you think I'm just trying to be scammed for w/e this guy can get? Is a dispute like this something I should be concerned about as far as losing my money? As a seller I feel i did nothing wrong, I gave pictures and info when asked, I included extras and service not listed on the auction and kept in contact as much as possible with the buyer before the purchase.

if paypal hasn't locked the money in your account, transfer it to your bank account immediately... then you can calmly proceed with the dispute

paypal/ebay are very pro-buyer and anti-seller, so i'd expect the seller to win...

u mean buyer to win

and i agree paypal DOES NOT protect the seller. paypal is a very shitty service and I dunno why so many ppl still use em. I guess the only option is money bookers really and I never used them so I dunno how they are.

Unfortunately you will lose the case. I never sell anything to buyers who ask too many questions.

I'm not as convinced as these others that ebay/paypal is so buyer oriented. I bought a lot of hard drives a couple of years ago that the seller did not package correctly and the drives were unusuable when I got them. Paypal sided with him and I now have useless drives that I paid for.

Just be honest in the dispute and provide all conversations that you had with the buyer. Keep your fingers crossed.

yea thats what I just finished doing. Had to upload 22 pictures worth of emails and photos that were sent between me and the guy as paypal evidence for the claim.

Of course I'm going to be honest with it, I have nothing to lie about as this guy is making himself look like the jerk on his own, I have emails showing that he twisted the words of my auction / my emails to make himself look better.

fingers are crossed...


And to the person that said to take the money out of my account. Paypal holds payments now for up to 21 days before releasing it to your account to make sure the item gets delivered and the buyer is happy. So future reference to anyone that hasn't been on it in a while. don't expect "buy it now" to mean Recieve Payment Now anymore

When did this get implemented? I just sold some stuff last week and this wasn't the case...

So judging by what you say about his feedback, he's got a pretty good scheme running to get free shit.

WHat happened to the good old days of, "buyer doesn't like item. Buyer returns item at his expense, seller returns money, life goes on"?

That would be the end result - if paypal sides with the buyer, it's basically a mandatory return. They aren't going to give him his money back AND let him keep the PS3.

not sure, I haven't sold anything for a while so it was new to me as well. I believe its only for items over 100 dollars though.

what happens if you get your shit back and it's broken?! Do you file a dispute against the buyer, who won the previous dispute?! This shit is retarded.

lol at complaining at scratches at the bottom. If PayPal weren't a bunch of douchebags, they'd use their brains and rule in your favor for the guy being a jackass complaining about scratches at the bottom and back of a game console. Who the hell looks at the bottom and back? Is he going to run the system while it's upside down? Dents and cracks are one thing, but scratches, c'mon now...obvious scam artist is obvious.

This is why I only use Craigslist now. Buyer can come and inspect the item with their own eyes and decide if it's in the condition that they want. If they change their mind, then I just lose a few minutes of my time instead of hundreds of dollars...

Just make sure to say "as is" so if they come back a week later and claim it broke and you're responsible... you can go tell them to fist themselves.

As for people who say they get mountains of spam and retarded e-mails when using CL, I've never had the problem before. Maybe I'm just lucky.

so when i filled out all the info last night for the claim paypal said it could take up till dec 4th, kinda suprised they finished already.

End Result: buyer has 10 days to send console back for full refund.. Which is fine I guess as someone else with common sense will easily buy it but it annoys the shit out of me that something so minor can let someone get away with this shit.. I could understand if the console had been brand new and was scratched, but to complain about scratches on the BACK and BOTTOM of a 3 year old console is just stupid. hope the guy dies in a fire >_>
